I have submitted my citizenship for the confirmation of order with Capital Express Nepal Private Limited. In case, I cancel the order after confirmation Capital Express Nepal Private Limited can take legal proceedings against me for compensation under breach of trust act, Rules of Nepal Government and electronic transaction act 2063.

मैले Capital Express Nepal Private Limited मा अर्डर पुष्टि (confirmation) का लागि आफ्नो नागरिकता पेश गरेको छु। यदि अर्डर पुष्टि भइसकेपछि मैले अर्डर रद्द गरेमा, Capital Express Nepal Private Limited ले म विरुद्ध विश्वासघात सम्बन्धी कानुन, नेपाल सरकारका लागू नियमहरू तथा विद्युतीय कारोबार ऐन, २०६३ अन्तर्गत क्षतिपूर्तिका लागि कानुनी कारबाही गर्न सक्नेछ।

I have ordered my product with facility of 100% CASH ON DELIVERY and OPEN BOX DELIVERY and have not paid any amount in advance for order.

I have agreed the timeline of delivery that is 15 to maximum 20 days incase capital express nepal private limited does not fulfil the order in the given timeline. Order will automatically be cancelled and agreement will void after that timeline.

Capital Express Nepal Private Limited is not liable any disputes related to quality issue. We check order as per picture mentioned on websites along with the size that customers ordered. Incase size is incorrect as per the order placed we will exchange the size as per the initial ordered. There will be no charge of exchange.

Capital Express Nepal Private Limited कुनै पनि गुणस्तर (quality) सम्बन्धी विवादका लागि जिम्मेवार हुने छैन। हामी वेबसाइटमा उल्लेख गरिएको तस्बिर तथा ग्राहकले अर्डर गरेको साइज अनुसार अर्डर जाँच गर्नेछौं। यदि अर्डर गरिएको साइज अनुसार सामानको साइज फरक भएमा, हामी प्रारम्भिक अर्डर अनुसार साइज परिवर्तन (exchange) गर्नेछौं। यसका लागि कुनै पनि अतिरिक्त शुल्क लाग्ने छैन।

Order once placed will not be cancelled. Incase i cancelled i am liable to pay all the compensation to Capital Express Nepal Private Limited.

Capital Express Nepal Private Limited has rights to cancel my order incase if there is any discrepancies with my information provided during processing of order.

अर्डर प्रक्रिया गर्ने क्रममा मैले दिएको जानकारीमा कुनै पनि असमानता (discrepancies) देखिएमा Capital Express Nepal Private Limited लाई मेरो अर्डर रद्द गर्ने अधिकार हुनेछ।

This Digital Agreement is entered into between Capital Express Nepal Private Limited (hereinafter referred to as the “Company”) and the undersigned customer (hereinafter referred to as the “Customer”).

यो डिजिटल सम्झौता क्यापिटल एक्सप्रेस नेपाल प्रा. लि. (यसपछि “कम्पनी”) र तल उल्लेखित ग्राहक (यसपछि “ग्राहक”) बीच सम्पन्न भएको हो।

The purpose of this Agreement is to confirm the Customer’s order upon payment and to establish legally binding terms regarding cancellation and rescheduling.

यस सम्झौताको उद्देश्य ग्राहकले भुक्तानी गरेपछि अर्डर सुनिश्चित गर्नु र रद्द वा पुनःतालिका सम्बन्धी कानुनी रूपमा बाध्यकारी सर्तहरू निर्धारण गर्नु हो।

I, the Customer, hereby agree and confirm that I am paying NPR 500 (Five Hundred Nepali Rupees) as a non-refundable amount to confirm my order with Capital Express Nepal Private Limited if cash on delivery amount exceed ten thousand nepali rupees.(10,000 NPR)

म, ग्राहक, यसद्वारा NPR ५०० (पाँच सय रुपैयाँ मात्र) फिर्ता नहुने रकम कम्पनीसँग मेरो अर्डर सुनिश्चित गर्न भुक्तानी गरेको पुष्टि गर्दछु।

1. I fully understand and agree that after confirming my order.
   म पूर्ण रूपमा बुझ्दछु र सहमत छु कि अर्डर पुष्टि भएपछि।
2. I will not cancel the order under any circumstances.
   म कुनै पनि अवस्थामा अर्डर रद्द गर्ने छैन।
3. I will not request to reschedule the order.
   म अर्डर पुनःतालिका गर्ने अनुरोध गर्ने छैन।
4. I will not reschedule or delay the order at the time of delivery.
   म डेलिभरीको समयमा पनि अर्डर सार्ने वा ढिलाइ गर्ने छैन।

म, ग्राहक, यसद्वारा NPR ५०० (पाँच सय रुपैयाँ मात्र) फिर्ता नहुने रकम कम्पनीसँग मेरो अर्डर सुनिश्चित गर्न भुक्तानी गरेको पुष्टि गर्दछु।

In case I cancel or attempt to reschedule the order after confirmation, I acknowledge that: The Company shall have full legal rights to take action against me. Such action may include claims under breach of trust and applicable provisions of the Electronic Transactions Act, 2063 (2008) of Nepal. I may be held liable for damages, losses, and legal consequences arising from such breach.

यदि म अर्डर पुष्टि भएपछि रद्द वा पुनःतालिका गर्ने प्रयास गर्छु भने: कम्पनीलाई मेरो विरुद्ध पूर्ण कानुनी कारबाही गर्ने अधिकार हुनेछ। यस्तो कारबाही विश्वासघात (Breach of Trust) तथा विद्युतीय कारोबार ऐन, २०६३ अन्तर्गत हुन सक्नेछ। म यसबाट उत्पन्न हुने क्षति, हानि तथा कानुनी परिणामको लागि जिम्मेवार हुनेछु।

This Agreement shall be governed by the laws of Nepal, including but not limited to: Electronic Transactions Act, 2063 (ETA) – recognizing digital agreements and electronic consent as legally binding. Muluki Criminal Code, 2074 – provisions relating to breach of trust and fraudulent intent.

यो सम्झौता नेपालको प्रचलित कानुन अनुसार सञ्चालन हुनेछ, जसमा: विद्युतीय कारोबार ऐन, २०६३ – डिजिटल सहमति र सम्झौताहरूलाई कानुनी मान्यता दिने। मुलुकी अपराध संहिता, २०७४ – विश्वासघात तथा ठगी सम्बन्धी प्रावधानहरू।

By Filling this form, I confirm that: I have read and understood all terms and conditions. I voluntarily agree to this Agreement. My digital acceptance shall be legally equivalent to my physical signature.

यो फारम सबमिट गरेर म पुष्टि गर्दछु कि: मैले सबै सर्तहरू पढेको र बुझेको छु। म स्वेच्छाले यस सम्झौतामा सहमत छु। मेरो डिजिटल स्वीकृति मेरो हस्ताक्षर सरह कानुनी रूपमा मान्य हुनेछ।
